Ex-Appeal Court President’s daughter files suit over father’s properties

The daughter of a late President of the Customary Court of Appeal in Abuja, Justice Moses Bello, has lodged a suit before the Federal Capital Territory High Court in Bwari to challenge how her father’s properties were shared.

The Claimant, Ann Eniyamire, told the court that she was shortchanged by the executor of her late father’s will.

Eniyamire alleged that her deceased judge had in his will, instructed that all his assets should be shared amongst his wife and eight children, using 11.11 per cent sharing formula.

Cited as 1st and 2nd defendants in the suit marked: CV/667/2024, are; Reverend Father Ezekiel John and Christ the King Catholic Church Okene Parish.

According to the Claimant, the 1st defendant, adopted a sharing formula of 4.16 per cent as against the 11.11 per cent instructed by her late father.

In the legal process she filed through her lawyer, Yahuza Mahraz, Eniyamire, urged the court to declare that she is entitled to 11.11 per cent of all her late father’s properties, including his estates.

She further prayed the court to set aside the decision of the defendants and relieve them of their duties as executors of her father’s will.

Among other things, she beseeched the court for: “A declaration that the Claimant is entitled to a share of 1/9 or 11.11 per cent of all her late father’s assets of shares and stocks.

“An order of this court directing the defendants to account, tender and hand all necessary documents with regards to administration, management and distribution of the estates of the Claimant’s late father to any appointed administrator general.

“A declaration that the Claimant is entitled to 11.11%, being equivalent to 1/9 of shares concerning all her
late father estates of mab farms and stocks listed in relief “25” above.

An order of this honourable court directing the defendants to pay to the claimant the sum of N500,000,000.00 only as general damages.”

Meanwhile, the defendants have briefed a lawyer, Adewale Adegboyega, to file a preliminary objection to challenge the competence of the suit.

Consequently, Justice M.A Madugu, who is presiding over the case, adjourned till June 4 for definite hearing of both the preliminary objection and the substantive suit.
